TERMS OF SERVICE

General ordering conditions apply to the legal relations arising from ordering the products through the ordering environment of the products located in the SUNPROFIT LLC online store (hereinafter referred to as TreeBird) at www.treebirdeco.eu (hereinafter referred to as online store).

In addition to these general terms and conditions, the relationship between the Customer and TreeBird is governed by the laws and regulations in force in the Republic of Estonia, the procedure for processing personal data of TreeBird customers (privacy), available at www.treebirdeco.eu/privacy terms.

These general ordering conditions, privacy and the price list of valid online store products are available on the TreeBird website.


ORDERING PRODUCTS

The Customer selects the desired product(s), determines the quantity of each product, the payment for the products and the delivery method. Before the order is confirmed, the Customer can review the order and change the order. After reviewing the order, the Customer confirms the order.

All prices shown in the e-shop are exclusive of VAT as TreeBird is not subject to VAT. The price of the delivery method will be added to the price of the ordered products according to the delivery method chosen by the Customer.

It is possible to pay for TreeBird via the Maksekeskus/Payment Center link for the order confirmed by the customer. Transactions are settled in euros. The contract between the Customer and TreeBird shall be deemed concluded after the Customer has confirmed the order and TreeBird has provided the Customer with an order confirmation. The order comes into force by TreeBird by sending the product to the Customer. 


DELIVERY OF PRODUCTS

Goods can be shipped to all EU countries and the USA.

Shipping to Estonia:
The ordered products will be delivered by TreeBird to the Customer in accordance with the manner selected by the Customer upon submission of the order either via Itella SmartPOST or Omniva parcel terminal. 
The method of delivery is chosen by the Customer upon completion of the order and paid together with the order. Delivery prices are fixed in the price list, which is also visible to the Customer when ordering.
Omniva parcel delivery costs € 2.79.
The cost of the SmartPOST parcel terminal is € 2.79.
For orders over 30 € delivery is free. The customer must select the appropriate option for the free delivery on the shopping cart page.

Shipping to other European countries: 
The ordered products will be delivered by TreeBird to the Customer in accordance with the manner selected by the Customer upon submission of the order via an Express Courier (DHL etc).
The method of delivery is chosen by the Customer upon completion of the order and paid together with the order. Delivery prices are fixed in the price list, which is also visible to the Customer when ordering.
For orders over 35 € delivery is free within Europe . The customer must select the appropriate option for the free delivery on the shopping cart page.

Shipping to the USA: 
The ordered products will be delivered by TreeBird to the Customer in accordance with the manner selected by the Customer upon submission of the order via Fulfillment by Amazon (FBA).
The method/speed of delivery is chosen by the Customer upon completion of the order and paid together with the order. Delivery prices are fixed in the price list, which is also visible to the Customer when ordering.
For orders over 35 € delivery is free. The customer must select the appropriate option for the free delivery on the shopping cart page. 


TIME OF DELIVERY

The product is usually sent out within 1-3 working days. In case of delays in delivery, the Customer will be contacted as soon as possible.

SmartPOST (Estonia & Finland):
Upon receipt of the order parcel machine, a message containing the location of the parcel terminal, opening hours and personal door code is sent to the Customer's mobile and e-mail address. When entering the code on the touch screen of the parcel terminal, the parcel machine door opens and the customer receives the parcel.
The consignments are stored free of charge in the SmartPOST parcel terminal 7 calendar days, starting from sending the message to the Client's mobile and/or e-mail address. At the recipient's request, it is possible to extend the 7-day deposit term by another 7 days, which is free of charge to the recipient.

Omniva( Estonia):
After receiving the notification SMS, the Customer can enter the door code received by SMS on the touch screen of the parcel terminal and take the parcel from the opened parcel terminal.
After sending an SMS informing about the arrival of the parcel, the parcel is stored in the parcel terminal for 7 days. 


CONSUMER'S RIGHT TO WITHDRAW FROM THE ORDER

The Consumer Contracting Authority (hereinafter referred to as the Consumer) has the right to withdraw from the order of products without giving any reason from the moment of placing the order until 14 calendar days after receipt of the products, but only if the product is unopened. To cancel an order, the Customer must contact TreeBird by phone +372 58 558 731 or send an e-mail to info@treebirdeco.eu.

If the Consumer withdraws from the order, the Consumer undertakes to return the unused and undamaged products immediately, but not later than within 14 calendar days from the submission of the withdrawal request. The consumer must return the products via the parcel terminal.

Return of goods ordered via SmartPOST parcel terminal:
The recipient has the opportunity to return the goods ordered from the online shop to the sender within 14 days. The shipment can be returned with the same door code as received from SmartPOST parcel terminals located in Estonia.

Return of goods ordered via Omniva parcel terminal:
The customer will return the ordered goods to the TreeBird via the parcel terminal following the terms and conditions of the Omniva private customer.

In case of both return methods, the costs of returning the products shall be borne by the Consumer upon withdrawal.

TreeBird returns the amount paid for the returned products to the Consumer and the delivery fee to the extent of the amount paid by the Customer, but not more than the price of the preferred mode of transport selected for delivery in the area. If the Consumer partially returns the ordered products, TreeBird returns the delivery costs in proportion to the number of products ordered. TreeBird will return the money within 14 calendar days at the latest upon receipt of the notice of withdrawal, but not earlier than within 3 business days of receipt of the returned products by the Customer. TreeBird returns the cost of sending to the Customer in full if the reason for the withdrawal is a defective or incorrect product.

If the Product returned by the Customer is used, TreeBird has the right to claim compensation for the loss of the product at the price. This amount shall be deducted from the amount to be returned to the Customer. 


CUSTOMER RIGHTS

The customer has the right to order products in the e-shop at the price set by TreeBird and on fixed terms. The product sent to the customer must be correct and complete and comply with the terms and conditions fixed by TreeBird.

If there is a defect with the product, the product will be replaced with the same product unless the product is no longer available for sale. If the respective product is no longer available for sale, the product will be replaced or the sales contract will be terminated at the Customer's choice and the cost of the product will be returned to the Customer. The contracting authority is entitled to rely on the legal remedies provided by law in the event of non-compliance with the contract. 


OBLIGATIONS OF THE CONTRACTING AUTHORITY

When placing an order, the Contracting Authority is obliged to provide the necessary information for the order: first name, surname, contact phone and e-mail address.

If the Customer and the recipient of the product are different, the Contracting Entity shall also provide information on the recipient. If the information provided by the Customer is incorrect and/or incomplete, or if the Customer has chosen a free delivery method for a shopping cart of less than 30 €, TreeBird does not warrant the proper performance of the product order. If possible, TreeBird will contact the Subscriber to clarify the incorrect or incomplete information.

When signing the order, the Customer confirms that he/she agrees with the terms and conditions set out in these General Terms and Conditions and undertakes to comply with them. 


TREEBIRD'S RIGHTS

TreeBird reserves the right to change these General Terms of Service without prior notice by publishing new valid terms and conditions on the Internet. TreeBird has the right to change the price list of the online store at any time without prior notice by publishing a new price list in the online environment. TreeBird has the right to refuse to accept an order or to cancel the order, for example, if the wrong price has been published in the price list or if the Customer has chosen a free delivery method for a basket of less than 35 €.  


TREEBIRD'S RESPONSIBILITIES 

TreeBird undertakes to deliver to the Customer correct and complete product(s) and to receive and document all claims of the Customer. TreeBird undertakes to settle the Customer's complaint within 7 working days if the reasons for the claim are not dependent on the Customer. If the cause of the claim is caused by the Contracting Authority, the Customer shall immediately eliminate it. TreeBird commits itself to exchange the specimens of the products.

All disputes between the parties shall be settled by negotiation. If no agreement is reached and the Customer wishes to continue with the complaint, the Customer has the right to address the Consumer Disputes Committee of the Consumer Protection Board at Rahukohtu 2, Tallinn 10130 or at www.komisjon.ee. The Consumer Disputes Committee is competent to settle disputes arising from a contract concluded between a consumer and an undertaking which the parties have not been able to settle by agreement. Reviewing a complaint by the Commission is free of charge for the parties.
